User Agreement from IDN Cosmetics

1. For services provided via the Internet and on the territory of Ukraine, the name «IDN Cosmetics» is understood as a Individual entrepreneur Koicheva Natalya Grigorievna TIN/USREOU 2863606869

2. The site https://idn-cosmetics.com/en (hereinafter referred to as “IDN Cosmetics”) provides the User with the opportunity to use the site https://idn-cosmetics.com/en (hereinafter referred to as the Site) on the terms and conditions set forth in this user agreement (hereinafter referred to as the Agreement).

3. This Agreement defines the terms of use by Users of the materials and services of the Site and regulates the rights and obligations of Users and «IDN Cosmetics», as well as relations with third parties whose rights and interests may be affected as a result of the actions of Users.

4. This agreement in accordance with Art. Art. 633, 641 and ch. 63 of the Civil Code of Ukraine is a public agreement (offer) and is addressed to an indefinite number of persons who wish to familiarize themselves with the information on the Site and/or purchase goods in the online store idn-cosmetics.com.

6. The user must carefully read this agreement before viewing and using the site.

7. The moment of concluding this user agreement is considered the moment of registration of the User on the Site. The user agrees that by registering by clicking the “Register” button, he agrees to enter into this legally binding agreement with “IDN Cosmetics” and confirms his agreement with all the terms of this agreement.

8. If the User disagrees with the terms of this agreement, he has the right not to go through the registration procedure and not to click the “Register” button; in this case, the User does not gain access to the services of the online store and does not have the right to use the information posted on the site in any way.

9. The User agrees that all the terms of this Agreement are clear to him and he accepts it fully and unconditionally.

10. This Agreement applies to the IDN Cosmetics Website and proprietary application «IDN Cosmetics».

1. After registering on the Site, the User gains access to the services of the IDN Cosmetics online store, gets the opportunity to place orders on the Site, choose a payment method for the Product and a delivery method (hereinafter referred to as Services).

2. After registration, the User can leave reviews on the site. The User agrees that his “reviews” will be available to all Internet Users. The user understands that any information posted by him must be truthful and must not harm IDN Cosmetics and third parties whose rights and interests may be affected by the posting of such information.

3. IDN Cosmetics has the right to delete information that is contrary to the terms of this agreement at its sole discretion, either with or without prior notice.

1. To use all the capabilities of the site that are provided to the User, in particular for placing orders on the Site, the User must go through the registration procedure and enter the necessary data according to the questionnaire.

2. When registering on the Site, the User undertakes to provide reliable and accurate information about himself and his contact information in order for IDN Cosmetics to fulfill its obligations to the User and deliver the paid Product to him.

3. During the registration process on the Site, the User specifies a login (his e-mail) and password, for the non-disclosure of which and their inaccessibility to third parties he is responsible. The user undertakes not to disclose to third parties the login and password specified during registration, and to store this data in a place inaccessible to third parties. For all actions performed on his behalf, that is, using his login and password, the User is solely responsible.

1. The user can place an order by clicking the “add to cart” and “checkout” button. After placing an order, the User will be sent a notification about confirmation of the order, to the contacts specified when placing the order, and the availability of the goods or the expected date of receipt of the goods in the event of its absence.

2. In the event of the absence of a product listed on the Site and the impossibility of its delivery due to technical problems, as well as for other reasons beyond the control of IDN Cosmetics, the specified order is canceled in whole or in part, and the User is informed by sending him a notification to the contact information he indicated during registration.

3. By joining this Agreement and placing an order, the User confirms that he is familiar with the “Delivery and Payment” sections of the Site, agrees with it and understands them fully.

4. «IDN Cosmetics» reserves the right to change the order delivery time with subsequent notification to the User.

5. The user agrees that the price of the product placed in the “basket”, its range and quantity, will be relevant only at the time the “basket” is formed and may change if the purchase has not been finalized by clicking the “place an order” button.

1. Information provided by the User is confidential. «IDN Cosmetics» uses information about the User to fulfill the User's Orders, unless other purposes are specified in this Agreement and the Appendix to it.

2. By filling out the registration form on the site, the User voluntarily consents to the collection and processing of his personal data by «IDN Cosmetics» for the following purpose: the data that the User provides during registration on the Site will be used to process Orders for the purchase of Products, obtain information about the Order, and deliver the Products , sending by telecommunications (e-mail, mobile phone) advertising and special offers, information about promotions, orders or any other information about the activities of the Site for other commercial purposes, subject to the terms of this agreement.

3. For the purposes provided for in the previous paragraph, “IDN Cosmetics” has the right to send letters, messages and materials to the User’s postal address, e-mail, as well as send SMS messages, make calls to the number specified in the questionnaire, if this is necessary to fulfill the User’s order. IDN Cosmetics has the right to record telephone calls with the User in order to improve the quality of the latter’s service, to which the User gives his unconditional consent.

4. The User agrees to the transfer of his data specified by the User when registering on the site to delivery services. “IDN Cosmetics” confirms that it will transfer to delivery services only that information and to the extent that will be necessary to complete the User’s order and make delivery.

5. The user agrees to IDN Cosmetics' use of cookie technology. Cookies do not contain personal information and cannot in any way read information from the User's hard drive. Cookies are used to improve the quality of services provided, including: to quickly identify the User; saving the User’s settings, his personal preferences, tracking the state of the User’s access session and his characteristic trends.

6. IDN Cosmetics also uses cookies for advertising purposes, including to manage advertisements on websites on the Internet. The user has the right to refuse the use of cookies. If cookie technology is disabled by the User, IDN Cosmetics does not guarantee the full functionality of the Site or some of its services.

7. The user gives the right to IDN Cosmetics to process his personal data, including: placing personal data in the IDN Cosmetics databases, storing data, accumulating it, updating it, changing it (as necessary). IDN Cosmetics undertakes to ensure the protection of data from unauthorized access by third parties, not to distribute or transfer data to any third party (except for the transfer of data to related parties, commercial partners, persons authorized by «IDN Cosmetics» to directly process data for these purposes, and also upon mandatory request from the competent government authority).

8. Details of the processing of personal data by «IDN Cosmetics» are described in the Privacy Policy to this agreement. By joining this agreement, the user confirms that he is familiar with and agrees with the procedure and method of processing personal data.

10. «IDN Cosmetics» is not responsible for the content and accuracy of the information provided by the User when registering on the Site and placing an Order. The User is responsible for the accuracy of the information specified when registering on the Site and placing an Order and agrees to bear all risks associated with the unreliability of such information.

However, if the law states that in order for IDN Cosmetics to legally provide services without parental consent (including the use of personal data), the User must be older, then the age in accordance with the law shall be used as the minimum age.

3. The User registers only one account on the site, which will be registered under the User’s real first and last name.

4. User by entering into this agreement agrees that it will comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws and regulatory requirements.

5. «IDN Cosmetics» will notify the User in the following ways:

5.1. Sending a message as part of the User's implementation of the Service using the contact information provided by the User to the email address specified during registration

5.2. Newsletter and offers from IDN Cosmetics. The User receives news and offers from «IDN Cosmetics» by email only if he confirms on the website his desire to receive offers and news by mail. The user can control and limit the receipt of news and offers using the settings on the pages of his account.

5.3. Through notifications to your own account.

6. «IDN Cosmetics» reserves the right to limit the User's use of the site, including the number of accounts.

7. By joining this agreement, the user confirms that he will not:

7.1. Act in an unlawful or unprofessional manner in connection with the use of the site, including, but not limited to, dishonest, offensive or discriminatory behavior;

7.2. Post inaccurate, discriminatory, obscene, shocking, hateful, threatening or otherwise inappropriate feedback, or publicly discuss personal grievances or disputes;

7.3. Create fake accounts on the site;

7.4. Create an account for anyone other than yourself (the actual person);

7.5. Use or attempt to use someone else's account;

7.6. Cause harassment, abuse or damage to another person;

7.7. Send or post unsolicited or unauthorized advertisements, questionable messages, spam or solicitation in any other form;

7.8. Copy, use, disclose or distribute any information obtained during the use of the site, directly or through third parties (for example, search engines) without the consent of «IDN Cosmetics»;

7.9. Use, disclose or distribute any data obtained in violation of the terms of this policy;

7.10. Disclose information without obtaining consent to its disclosure (for example, confidential information of other persons);

7.11. Infringe on the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights; for example, it is prohibited to copy or distribute information without permission from «IDN Cosmetics».

8. «IDN Cosmetics» reserves the right to limit, suspend or terminate the User's account if it believes that the User is violating this Agreement and/or the law and/or using the Site inappropriately.

1. The User understands that the site is an object of copyright of the owner of the Site, namely a complex of copyright objects, which may include computer programs, databases, musical works with and without text, literary works, audiovisual works, works of fine art, photographic works, derivative works; translation texts, which together constitute a website available for use by the User.

2. Use of the site does not grant the User any ownership rights to the site, as well as to the information posted on the site.The User confirms that he is prohibited, without the prior written permission of IDN Cosmetics, from copying, distributing or using in any other way the information posted on the Site, except for the purpose of receiving Site Services.

3. Trademarks and logos associated with the Site Services belong to their respective owners, the use of which without the written consent of such owners is prohibited by the current legislation of Ukraine and international law.

1. The materials and services of the site are provided “as is” without any warranties. IDN Cosmetics does not guarantee the accuracy or completeness of the materials, programs and services provided on the Site.

2. IDN Cosmetics may make changes to the materials and services provided on the Site, as well as the products and prices mentioned therein, at any time without notice.

3. If the materials and services on the Site become outdated, IDN Cosmetics does not undertake to update them.

4. Under no circumstances will IDN Cosmetics be liable for any damages (including, but not limited to, damages for loss of profits, data, or business interruption) arising out of the use, inability to use, or results of use of the site.

5. «IDN Cosmetics» does not bear any responsibility for the statements and opinions of the Site User left as reviews, comments or reviews.

6. IDN Cosmetics is not responsible for possible illegal actions of the User in relation to third parties, or third parties in relation to the User.

7. «IDN Cosmetics» is not responsible for the User’s loss of access to his account on the site.

8. 9. «IDN Cosmetics» is not responsible for:

9.1. Delays or failures in the process of completing a transaction that arose due to force majeure, as well as any case of malfunction in telecommunications, computer, electrical and other related systems.

9.2. Actions of transfer systems, banks, payment systems and delays associated with their work.

9.3. Improper functioning of the Site, if the User does not have the necessary technical means to use it, and also does not bear any obligation to provide users with such means.

1. The Agreement may be changed unilaterally by IDN Cosmetics without special notice to Users by posting at https://idn-cosmetics.com/en/content/terms-of-use new version of the Agreement.

2. The new version of the Agreement comes into force from the moment it is posted on the Internet, unless otherwise provided by the new version of the Agreement.

3. By continuing to use the site after the publication of a new version of this agreement, the User thereby agrees to the updated terms and conditions.

4. A user who does not agree with the terms of the current version of the Agreement in whole or in part is obliged to stop any use of the site.

5. IDN Cosmetics and the User have the right to terminate this agreement at any time.

6. The user terminates this agreement by independently deleting the account registered on the site.

7. «IDN Cosmetics» terminates this agreement with the User by deleting the User's account from the site.

8. In case of termination, the User loses the right to access the account and use the Services of the IDN Cosmetics website.

9. The parties acknowledge that upon termination of the Agreement, any amounts of money that either party owed the other prior to termination of the Agreement shall remain in the status of debt after termination.

1. The user agrees that the current legislation of Ukraine applies to this agreement.

2. The user agrees that any disputes related to this agreement and the services of the site must be governed by the laws of Ukraine.
